1. Introduction and acceptance

Trekvio (the "Service") is operated by SYNCWAVE LTD ("we", "us", "our"), a company registered in England and Wales, with its registered office at 18th and 19th Floors, 100 Bishopsgate, London, United Kingdom, EC2N 4AG.

By accessing or using the Service, including the Trekvio website, mobile applications, and related features, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Account registration

You must be at least 13 years old to create an account. You agree to provide accurate and complete information when registering, and to keep this information up to date. You are responsible for safeguarding your login credentials and for any activity that occurs under your account.

We may suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used in a manner that harms other users or the Service.

3. Subscriptions and billing terms

Trekvio offers a free tier and the following paid plans. All prices are in US dollars and exclude any applicable taxes. All paid plans renew automatically until cancelled.

Plan pricing

Auto-renewal and cancellation

Subscriptions renew automatically at the end of each billing cycle at the then-current standard price for that plan, using the payment method on file. You can cancel at any time from your account settings. To avoid being charged for the next cycle, you must cancel at least 24 hours before the renewal date.

Payments

Payments are processed by third-party payment providers. By subscribing, you authorise us and our payment provider to charge your selected payment method for the applicable amount.

Refunds

Refunds are governed by our Refund Policy. EU and UK consumers may also have additional statutory rights.

4. User-generated content and licensing

The Service allows you to upload trails, routes, photos, comments, and other content ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant SYNCWAVE LTD a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, publish, translate, and distribute that content for the purpose of operating, promoting, and improving the Service. You confirm that you have the right to grant this licence.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Upload content that infringes intellectual property, privacy, or other rights of third parties.
• Post content that is misleading about the safety, difficulty, or accessibility of a route.
• Attempt to access, tamper with, or reverse engineer parts of the Service not intended for public use.
• Use automated systems to scrape, harvest, or copy content without our written permission.

6. Intellectual property

The Service, including its software, design, logos, and trademarks, is owned by SYNCWAVE LTD or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in line with these Terms.

7. Disclaimers, including outdoor safety

Trail data is contributed by users and third parties, and may contain inaccuracies, be out of date, or be unsuitable for your skill level. Always verify routes against current local information, check weather and avalanche forecasts where relevant, and carry appropriate safety equipment. Do not rely solely on the Service for navigation in the backcountry.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, SYNCWAVE LTD and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service or from any outdoor activity undertaken with reference to information provided through the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded under applicable law.

9. Termination

You may stop using the Service at any time and may cancel your subscription from your account settings. We may suspend or terminate your account if you breach these Terms, fail to pay fees when due, or use the Service in a way that may cause harm to other users or to us.

10. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms, except where mandatory consumer protection laws give you the right to bring proceedings in your country of residence.
